My husband filed for bk and has been to court, we are waiting on the discharge papers. We were behind on the mortgage payments, the house is in my name also, and have every intention of retaining the property. We were scheduled for foreclosure hearing, but the creditor agreeds to stay the effective date of the order for a period of ten days. We have procurred the funds, but we will not have the money within the ten day period. My questions is this, will we have to go to court for the foreclosure hearing, or will they just automatically start proceedings?
