    What to do?

    If a credit card company get's a judgement against me can they take any of my furniture. I did charge some of my furniture on my credit card two years ago. Plus last year my house heating system went out and I purchased a new one charging it on my visa card. I purchased my TV on my sears card and I know they might want it back. My car is a lease. They can't garnished my VA benefits. The homestead act protects the little bit of equity I have in my home so the one thing they could get is some of my furniture. In yard sale value, I may be somewhat over the state exemptions by two thousand or so. I have about 90K in unsecured credit card debit. I am a senior citizen who will probably be gone before I could pay off a chapter 13. Also, I understand that the credit card companies won't negotiate on the monthly payments. My checking account is at the same bank that I have a visa card with? One attorney told me that I would not qualify for a chapter 7.

    How many attorney's did you interview?

    Move your funds from the bank where you owe your cc if they are kept in the same bank. Banks have the right of offset they can use at any time once you are delinquent and prior to your filing BK.

    If you bank with Wells Fargo its best to move your accounts anyway before filing. Search here for Wells Fargo + Freezing accounts.

      I have talked with three attorneys. The last one said I was collection proof but the creditors will hound me to death. He said send them letters telling them not to call. Also, he said the same as the other two, chapter 13 only.

        Do some research on this forum first.

        If you can, provide some of your details: your income, secured debt, unsecured debt. There have been people here that have been able to file and successfully get discharged from a Ch 7 BK, but of course, it all depends upon your assets, your income and your expenses. When you have researched this forum and the stickies, it will become more clear to you what to ask the attorney's to determine which you are qualified to file, a Ch 7 or Ch 13.
