I live in Arkansas and am about to file chapter 7 (hopefully). I work a regular full time job but my husband is self employed (has been for the past 20 years) I am trying to find out how his income is going to be determined. I asked my lawyer how monthly income was figured under these circumstances and his answer was "you decide what your monthly income is and we will report that amount on the schedule." That did not exactly answer my question. Also, my husband has had a loss on his business for the past four years so he recently took a temporary job that deducts payroll taxes. This job may last 3 months or 6 months. It depends on the contractor who hired him. The answer to this question will determine if we can file 13 or 7. So, I'm at a loss. Can anyone help? Thanks in advance for any helpful advice.

his income will be determined via his 1099 forms and other tax related documents. he simply needs to furnish proof of the last 5 -7 years of past earnings.
