    Dumb Question: Can a CA Look at Your Credit Report?

    I have looked through my notes and I am sure I read somewhere that CAs can look at your credit report.

    Yes? No?

    Kam, It just seems logical that they would also have access to your credit report, just like the credit people for a company or credit card.....

      Okay I was wondering, cuz NCO has been pulling hard copies of my CRs during the time we were in Ch7.

        Let them pull them, what are they going to do - build a bonfire out of them, lol.....
        If they pull an inquiry two often and especially during BK, call the credit bureau.............

          They need to have permissable perpuse. If you have an account that they are collecting on it-they have PP. Once you are in BK though, that is not the case.

          Was NCO listed in your BK, or are they handling an account where you only listd the original creditor? (Perhaps they got the account after you filed BK.) If they didn't know, the 1st one is innocent. After that, they have no excuse.

          It can be damaging, as inquiries impact your credit score for 12 months, though not as much after 6. And, it doesn't look good to have collection inquiries on after BK. (Inquiries indicate what they were for, though I've only seen that info on some versions of the report.) It would not be a bad idea to write to them, address the fact that you have filed BK and they did not have PP to access your credit. Violations can equal/exceed $1000 per pull. Request that they remove the inquiries.

          Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

            Yup, NCO was included, and yup I intend to write them and ask them for the paperwork showing where I gave them PP to pull my report. I'll wait the 30 days and then demand that they remove the pulls or cough up the money. These are for Cap1 accounts.

              As a former debt collector, 'yes,' is the answer. I used them to track address and job info, but it has its drawbacks if you are using them for skip tracing purposes. They also came in handy to see who you had accounts with in good standing, and I'd call them, and see what info they could give me in order to find a debtor.
              I'm not a lawyer or legal expert, just offering advice on what I may have gone through and/or have knowledge of. Good luck!

                The CA I talked to knew about open accounts that I had credit with but I didn't even know about. Apparently it was accounts I haven't used for a long time and should probably close. I could tell they were trying to use verbage to trick me into saying something they could use against me. They knew about my place and vehicles too. I told them one runs and the other is tore apart for rebuild, which is the truth. They will use tactics like you wouldn't believe...calling your neighbors...etc. I hate em with a passion.

                  CA's look at your cc report mainly to determine how they approach getting money from you. In my case, the CA for MBNA snooped in my cc report about 7 months ago and the next thing you know I was process served to participate in the National Arbitration Forum.

                  I'm not trying to scare you, but they saw that my income increased and that gave them cause to go after me. So they thought. Or they might not think your worthy either and hawk your account to some other fool for pennies on the dollar.

                  Unfortuneately, when you sign there agreements you are giving them access to your living room.
