I am currently living in Japan and I am starting my research for bankruptcy.
Can someone tell me if I have to be in the states to file and complete everything or can it be done with me out of the country?

I thought my disability was temporary, but it has been 5 years now and I know I will not be able to return to work or pay my bills. Since US immigration law does not permit my gay partner of 8 years to immigrate, reside, or work in the US, we are forced to live in Mexico where my spouse can support us (megerly). I've been trying to find information on filing bankruptcy. I've lived in Canada for 3 years and the savings that I was using to pay my US debt is gone.
I have contacted numerous people from debt management counselors to lawyers and have received different answers. I have been told that I will have to appear in court where the bankruptcy is filed and that it must be filed in the state where it occurred, and then again I was told that since I am not a US resident, that I can not file for bankruptcy.
It is important that I get this settled, I want to repay the debt owed, however my employment situation will not permit it.

I have just come to the realization I will have to file bankruptcy. Like the others listed in this forum, I have been living overseas - in Ireland for five years- and will have to contact a bankruptcy lawyer in the states.
Do I have to file in the state I last lived in? Will I have to return to the states to appear in court? And can credit card companies serve me to appear while I live over here (they are threatening to). Will my bad debt in the states follow me here? And if so is there anything I can do about it now?
Any help would be appreciated.
