    60 days and nothing

    Hello everyone
    I have past the 60 days and no word from My attorney ...
    We called his office and were told not to call unless we hear anything from them . So is it still a waiting game? How do we know if it actually was discharged? This is feels kinda weird. My husband said when he called the office the assistant to the attorney told him that. Is that normal? I guess we have called one to many times.. I realized it has only been since Dec 18 th but I guess we are anxious to make sure everything is okay to ease our minds .. We are down to only one car and it is going it breaks down every other day so we are in need of getting another one. It is hard to get to work this way and depending on someone else. I know about the Pacer but I do not have a acct it can be billed to .. so I am out of luck there..

    Any thoughts please.. let me know .. thanks so much...

    go to the court house. they probably can let you look at it free.

    i used my visa check card. if you dont have one then its time to get a checking account and fast.

        Debit card works-that is what I signed up with.
        Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

          Okay it did work .. I got into Pacer .. that was quick...
          So it says ... Case Open... I think like 160 days or something like that..
          also there is a 11/2/05 notice of appearance not sure what that is I never recieved it...
          No discharge though .. Does anyone know if this is going in the right direction? thanks

            notice of appearance, which you can search for on this board, is when a creditor's attorney wants the court to send him any paperwork in the future. standard stuff.

            everyones pacer dates and times are kinda different. focus on your discharge date. that is the key.

              Call your BK district's court on Tuesday (probably closed on Monday) and speak to the clerk of the court. Let them know you're following up, because the deadline for objections passed and you haven't received your discharge. They will likely enter the discharge for you. That is why mine was discharged yesterday. (From looking at Pacer, my district hasn't discharged but a few of the August filings, so no telling when it would have been entered if I had not called.)

                Okay thanks , no no worries about the notice of appearance.,. thanks goodness ,, I will call on tuesday .. to see.. there was a another judge 's name on the docket info .. besides the trustee... is that okay?

                  trustee is not a judge. in bk cases there are:
                  - you
                  - your attorney
                  - trustee
                  - us trustee
                  - judge
                  - creditor(s), collection agencies and other pukes

                  then, each one of them have an attorney as well. except for the judge - unless you sue him, which btw isnt recommened during your bk process

                  the judge rules on everything, motion, complaint etc in your case. he is protecting you from the others (yeah right lol)
