    Discharge - What's Next?

    Just checked Pacer and it shows that I was discharged yesterday, Jan 4th.

    Checking other cases its taking them about two days to mail out the discharge and a week to close the case.

    What does case closed mean to me? Can a creditor reopen a case? I had a second mortgage holder on my home I sold in July that didn't record their lien against my property but against one of my old neighbors. I sold the house and the title company never found the lien and later after I sold the house is when I discovered the lien was unperfected and not against my home.

    Can this second holder have the case reopened? I listed them on my petition and know that they received it because they sent me a letter asking if I wanted to reaffirm.

    Any thoughts out their?

    geez, im not sure as to the specifics but...

    when the case is discharged then its too late for any creditor to object.

    if there is proof of fraud then the us trustee can reopen the case easy.

    if you are saying a creditor missed their chance but you listed everything honestly and truthfully then id have to say you are in the clear.

    anything can happen though. but usually doesnt. congrats on the discharge!

      Generally, your case would be reopened if the trustee had reason to suspect fraud or if there were assets found.

      Regarding the unperfected lien, that was an unsecured debt and discharged with the bankruptcy. It will be a lesson learned to the 2nd mortgage co-to do their job right from now on!

      As to what comes next-take it day by day. Live your life, spend less than you earn, and try to get to a point where you can aside a few dollars here & there.
