    Tax refunds

    I saw a post about this but didn't see an answer. If the Trustee doesn't mention or ask for a copy of your tax return at the 341a how does he know if you do get one in the spring?
    Is he likely to come back at a later date and investigate whether you got a refund or not?

    likey i dont know. its all up to whatever the trustee wants to do. they have resources and can do anything.

    if he didnt ask about it at all them dont worry.

      Have you gotten a good return for the past few years? My wife and I have usually received a $4800 to $5200 for the past few years, and I'm sure this caught our Trustee's attention. He brought it up at our 341 and we have to send him (and our atty) a copy of our tax return when we file. That is the only asset in our case.
      Bankruptcy History:
      Chapter 7 filed - 10/12/2005 - Asset
      Discharged - 02/16/2006
      Case Closed - 11/08/2007

        Yep, had a big tax refund last year--and the trustee already has a copy of last years--BUT my income is about 40% less than it was last year so I don't even know if I will be getting anything back or not. Guess I'll see what he says. Losing 1 years refund is worth it anyway to get out from under all the other mess.

          If trustee did not say anything, then you are prob. 99% home free. If they are interested, they will say so or make you sign something.
          When was your 341 and when is your discharge? If you already gave that info, forgive me for asking. I'll re-check you original post after I submit. Art

                Imagine the look on a trustees face if you told him thats how you spent your tax return. I think it would go like this: Utter disbelief and speechlessness, then gradual acceptance and approval after a few awkward moments of silence

                      So I usually get back about $3K. The trustee did not say anything to me at the 341 about turning over my 2005 tax return. She did tell some people that if they don't submit theirs that she will revoke their discharge. So, should I call my lawyer and ask? I don't want to bring about any unwanted attention. I did not sign anything. THanks

                        It very well "Could" be the trustee "Overlooked it" but if discharge has occured, I kind of doubt there's anything more that may happen..But check with your lawyer to be sure.

                            My 341 is this Friday--long wait here in IN--I filed 10-13-2005. It is listed as no asset at this time--but maybe he will change it when he sees what I got back last year. I do not expect a big refund this year because I changed my exemptions and I am making about $24,000 less in income this year. Guess all I can do is see what happens Friday. thanks for all the posts

                              bilbo, good that you changed the exemptions

                              also, take your last stub for last year and find a IRS site tax calculator. maybe you can figure out what you will be having left. depends on how you file taxes. or do some ration calculations based on prior year.
