    Dreading the 341

    First of all I would like to say how thrilled I was to find this site. It contains answers to many of my questions and contains a tremendous amount of information. Thank you to everyone who posts, moderates, administrates. You are what keeps this forum going.

    My chapter 7 case was filed on 12/28/2005 and I am now waiting for the date of my 341 meeting. After consulting three seperate bankruptcy attoryneys I finally decided on one. What I did discover from the three is that there is HUGE confusion with the new bankruptcy laws. One attorney said Chapter 13 while two said I could file Chapter 7. It seems there is a lot of room for interpretation with the new laws and until precedence is established no one really knows what is allowed and what isn't. I was over on the gross income but through my attorneys interpretation I was allowed to file under chapter 7. Which is a huge relief.

    Does anyone have any experience at the 341 meeting and beyond after the new bankruptcy laws? My attorney said people arent filing nearly as much after the change in laws and this worries me b/c this may give the trustees more time to focus on me. I guess the worst that can happen is I will be forced a Chapter 13.

    Just looking for some chapter 7 experiences after the new laws!! Thanks.

    Good idea seeing a few lawyers. The median income part has been so exagerated as well as the changes in law. It's only the 1st part in the test. There are things such as reasonable living expenses, high cost of energy, health insurance and other allowed expenses that will allow debtors to get relief with a chapter 7. I wouldn't worry about them focusing on you. If the test states that your expenses are allowed and reasonable then they are. The rate of filers will probably be back to it's normal level in time according to some news recently posted. Just be very honest and double and triple check all the paperwork no matter what. Mistakes are very costly under current law.

      experience for the 341 for new bk law? nope. but im sure they are the same. the forms that most of us used were the new 341 sign in forms used now. they updated them before the new laws change lol.

      anyway, the 341 is the easiest part of the entire process. you are treated with respect, its quick and you are so damn happy afterwards you just wont believe it. go to 3 local 341 meetings and see for yourself. we did. let us know how it went.
