    Trustee Intends to Abandon??

    Checking my pacer updates and this is what I have found on status so far:


    What does this mean exactly: Trustee intends to abandon all interest in (and then the pacer lists real estate property, cars, and personal items).

    And then behind each shows a letter abbreviation behind each item listed. Such as an (a) (d) or a (c).

    It means the trustee believes you have nothing he can take...

      when you file a bk all of what you own becomes the trustees property. every single thing down to your hairbrush.

      as the case progresses the trustee must release these things if they are exempt. he has found them to be either exempt or of no interest to him so he has to give them back.

      send him a 'Thank You' letter for the gifts

        Oh, I see. I am very happy actually about the home, we do need a place to stay. And since Hurricane Katrina did not take ours, I was hoping that Hurricane US Trustee wouldnt either! But I believe the Trustee will take some other assets we have- CASH for our living expenses that insurance company gave us to survive. I hate living in fear of what is going to happen. Our livlihood is in the hands of the US Courts.

          hmmm.....cash is usually unquestionably taken except for the little bit you are allowed to exempt. Under the circumstances that may not be the case though. Did your atty say anything about this? Did he make any effort to inform the trustee about the nature of this cash?

            Either your attorney listed the cash w/ an exemption, didn't list the cash at all, or the trustee is not going for blood. What does it show on your petition?

              We filed pro se. No attorney at all will call us back during this time and one is hard to come by.

              At the 341 meeting, The trustee said that we needed to amend ( I have no idea how to do this) our 50.00 cash on hand and the 2000.oo insurance check for living expenses we had received during evacuation.

              I had listed them as exempt on our shedule c. She also wants my medical class act settlement that has been going on for almost 4 years now (still waiting for it). She also wants to see our taxes for 2004 which means she may want our 2005 tax return too.

                well, take you forms and pay an attorney a few hundred to explain what shoudl be done. he might find something that will save you that much money. the trustee isnt your friend by any stretch of the imagination.

                  Sorry Rimi-I remember your earlier posts now!

                  To amend, just do a new exemption schedule citing the appropriate code & amount for each asset. You have to match up your assets to exemption codes. Do you have a reference for LA exemptions, their amounts & codes?

                    I have the NOLA book and I thought that I did the schedule c correctly, but obviously not. If it is not in the NOLA book, then no, I do not have them. Do you have a link for them? I do not have any more forms either. How can I obtain those?

                      consider an attorney. sounds like we are talking about high values amounts and settlements that you need.

                        The Nolo book (I'm not sure) may only list federal exemptions. Try bankruptcyaction.com, or look up your districts court website. If you go to bankruptcydata.com, they have a list of court links.

                          Thanks guys for the info.

                          I have tried getting a lawyer this whole week. I cannot even get one to call me back. A couple of them they would not handle it since we already filed and had the 341 meeting and they said it would cost us the same amount as a normal bankruptcy 1200.00 or more even if they did take us on.

                          I have to have this paperwork turned in within 10 days, which means this monday coming.

                            you can pay them for a meeting to go over questions. explain its just about exemptions. ask how much for each hour.

                              In other courts, you can file for a continuence to give yourself more time. Not sure if you can in bk court but you may want to check into that. They have to be filed a certain length of time before the hearing though.
