How can I keep my wife out of filing chpt. 13 with me. She doesn't want to and I don't either. She works, but her money have always gone towards her expenses.

HHM 01-05-2005, 06:47 PM She does not have to be listed as a debtor in the chapter 13, you can file individually; but you will have to list her income and expenses on the BK schedules (schedule I and J specifically), there is no way around that. And her income and expenses will go into determining you Chapter 13 plan payment. | |
