    OMG what is with this tax refund giveaway :(

    ARRRRg I wasn't expecting to have to give up my tax refund this year because of my lack of funds, I had some repairs to make to home. I am very new to this...Just recently divorsed..of course not getting any child support....If I was getting that I would have not had to file this Chapter7....Do we have to call out lawyers, or trustee before we buy anything? I now have a house I can't afford to live in....Will I be alowed to sell this house?

    WE need more info-to start with, when did you file & where are you in the process?

      the trustee can take the tax refund. all trustees are different. it also depends on when you file.

      you dont give enough info about your case or your home to know what you are asking. it depends on how much equaity is in the home and if you can afford to reaffirm the mortage.

      if you have an attorney, what did he say?

        I do have a lawyer, I filed back in October 2005... I just had my hearing last week. no creditors showed up...I am not really being advised about anything just kinda out there??? Well, there is no Equity in the house or not enough for them to mess with it. I refinaced 2 years ago to pay off debts then.

          and what did the attorney and trustee say about the house?

          your expenses were dealt with for the chapt 7 adn you must have talked about the home.

            Since you are still in BK-it is not too late to decide to let the house go. Discuss w/ your attorney, but you should have a few months at least to work on finding a new place to live. (Foreclosure is generally a long process.)

              The Lawyer said he was going to reafirm on the house...all that he said!!.so ??? I am trying to keep it in a sense...I have remained current on the house. I just wondered if I NEEDED to sell it would I have to seek permission??? Do I have to tell trustee when, why, and how much???Seems like like for a certain amount of time we are in prison and being watched??

                  Anita-this needs to be about you, not your attorney. He can't do it, though he can help you along the way. If you think there is even a possibility that you may not be able to manage the payment DO NOT reaffirm.
