    What are my rights when my landlord files bankruptcy. Can I get the information? Will I have to move?

    Did you sign a lease with your landlord? What type of information are you seeking? If the landlord is planning on foreclosing on the property, yes you'll be required to move. A landlord typically provides thier tenants anywhere from 30, 60, to 90 days notice of thier intent to file. If you signed a lease, see if there is a bankruptcy clause in it.

      I'm in the same boat

      We just found out today that our landlord is filing bankruptcy and losing all his rentals including ours. He gave us a 30 day notice as required by our lease. There is no mention of bankruptcy in our lease. Is it possible that we can take over payments (refinance, whatever) through the bank that holds the loan for this house, so that we can stay here? And how would we go about doing that?

        Well, at a minimum, you may want to make claim for any deposit you gave the landlord. However, you will probably have to move.
