    After Chapter 7 & HOA fees

    Sorry for the repeat. I posted in the foreclosure side a few weeks ago and no reponse.

    I moved out of my house in May 05 and surrendered to mortgage company. Filed for BK June 05, discharged Aug 05 - house, bills and all.

    House actually foreclosed in Dec 05 (bought back by bank and relisted - negative equity). The HOA called and asked where to send my payment book. I told her that I filed BK in August and I no longer owned the house.

    2 weeks later I received an attorney demand letter for assessments and legal fees $1400. Am I responsible for this?

    (I filed bk though a fly-by-night attorney who made it clear that it was about $$$ for him and the minute I stepped out of court and onto the elevator I was on my own from that point on.)

    first, if that is really true about your attorney - give him one last chance to asnwer your question about why and if the HOA has a case.

    if he doesnt asnwer then bring a complaint against him with the bar. who cares why. just bring it. it causes problems for him. its absurd that he wont speak to you about any options. even if those options are to give him more money to do more work.

    if you listed the home in your bk then its not your home anymore. you, imo, were not responsible for it then or at worst after you moved out in may.

    did you get a bill yet? what dates does it list amounts owed for? get detailed itemized bill from them. just becuase you get it doesnt mean you owe it so dont worry about asking for it.

    if the dates are before you filed bk then threaten them with legal action under BK law. collection of discharged debts are prohibited. read it for yourself on the bk discharge form.

    let us know what dates they are trying to collect for.

    also did you speak with their attorney? what did assh*le say to you?

    also, what did you attorney say when you called him about this? send him a certified letter asking if this is legal or not after you get the bill.
