    Personal BK and S Corp

    We are filing personally, but own an S Corp. Are all finances of the S Corp completely separate from our personal filing? I ask because one form has asked us to list business inventory and I need to know if this means inventory from the Corp. Thanks, slreiff

    Hi,

    Do you plan on filing yourself or will you be hiring an attorney? Most people incorporate the assets of the S Corp into thier BK petition. What you do really depends on your personal situation and your states law.

      We are planning on filing ourserselves, not using an attorney, and not including the S Corp assets. We're in florida and I'm not sure what the laws are here.

        I also filed but included my S Corp. I am in Florida. You need to get the advice of an Attorney. It will be tricky without one. I can almost guarrantee that you will have at least one deposition with the Trustee's Attorney. You are already going in unsure of what the Law is. Be very careful, they can be viscious.
