    10 years after bankruptcy

    Hello everyone, I'm new here and glad I found this site. My problem is this; I filed bankruptcy 10 years ago and was in the process of paying back my student loans. My bankruptcy attorney said I had to list everything I was making payments on so we listed the student loans. The bankruptcy was discharged and a payment arrangement was made for the sl's ($50 a month instead of the $175 I was making). I made my payments on the sl's for 6 months on time. Then I received a letter from my atty. included was a check for all of the monies I had paid in and a letter from the student loan service center stating that my accounts were closed. My atty contacted their atty by phone and she confirmed this. I then contacted the sl service center myself and talked to the Supervisor of Accounts and he said yes my accounts were closed and there was no reason for them to contact me anymore or vice versa. I have filed taxes every year since then and have gotten a return every year, I have also had several bank loans and bought a house in the last 10 years. The student loans are even listed on my credit report as -closed- and amount owed $0. Now I get a letter from the student loan service center saying that I owe them all of the money plus $8,000.00 in interest for the past 10 years! I have contacted my bankruptcy atty and they no longer have any of my files, also the slsc says they are going to take my tax return this year and if the investigation goes in my favor they will still keep my money! I would appreciate any advice and a BIG Thank You just for letting me vent!

      hey, thanks for getting back to me. I got in touch with the Federal Court and they said they could make a copy of my entire file for $35.00, so I figured, hmm. 35 bucks to save 20,000 I can do that. I only hope that my bk atty filed a copy of the letter from the slsc and a copy of the check before he sent them to me. I wonder sometimes, ok most of the time what gives these bullies the right to do this to people and how many people a year they squeeze money out of? I think they don't expect most people to fight back and to just roll over. I have a question though, since the payments were arranged in Federal Bankruptcy Court, and the slsc stopped them when they closed my accts, then there should have been papers filed to prove to the court the reason I stopped making payments or else the courts would have come after me right then, right??? I mean the slsc said all my accts were closed in the letter I received after 6 months. Plus, I have copies of my credit reports which for the past 10 years shows the accts as closed and balance owed as zero.

        Since it was 10+ years ago, you need to check the status of the law regarding student loans back then. I don't recall when they made student loans non-discharable, so they may have in fact been discharged.

          The new bankruptcy law affecting student loans went into effect on October 7th, 1998, so I think we'll be okay on that. Another thing that just recently crossed my mind is this; the slsc is the one doing the investigation to determine whether they have a right to take this money and since they are the ones that would benefit??? Does anyone else see a conflict of interest thing going on or is it just me???
