Is past OT used to figure future income
I am considering filing Chpt7 in CA. I was wondering how voluntary overtime is considered when determining my income. I have gotten myself into a big hole with cc's. I have to average 15-20 hours per week of ot in order to pay the minimums on everything. Years of this work schedule is killing me. I want to cut back. My annual salary on 40hrs/wk is about 50k, but I've been avging 85k with OT the last several years. Would a trustee only count 40 hrs/wk when calculating my future income, or would he say suck it up and keep working?
