    Filling in 2 days, have not filled taxes!!!... is this REALLY BAD?

    Ok long story short is I have NOT filled for my 2004 and 2003 STATE tax returns. I only did my federal for the past 3 years. I also did my state for 2005.

    The other thing is I have prepared my state tax returns for 2004 and 2003
    and I show that I do not owe them any money and WERE suppose to get like $60.00 back from them, each year.

    So if I just give them a copy of my prepared state taxes will my lawyer and the court accept it and believe me or will they actually check with the state to see if it's a real tax return? Do they check federal tax returns with the irs?

    If the answer is YES they will check with both state and federal, then should I send my tax returns out ASAP? Also should I tell my lawyer about this situation?

    We've only had attnys ask for Federal. Not one has mentioned wanting to see our State taxes at all. So I don't know if you're gonna have a problem or not.

    The attnys do want the 2005 taxes filed before we file BK, tho. They've all said that.

      Just wanted to mention something that happened with our case. We had filed our state/federal tax returns for 2003, but had to file an amended return for the year because of some things that came up. After our 341, we received a letter from the state asking us to submit our 2003 tax returns or they would make a motion for the dismissal of our case. We of course, sent copies of our amended return back to them and never heard anything about it.

      You will definatly want to speak with your lawyer about this and ask him what you should do. I just know that in our case, the state wanted our return.

        You may want to have it all filed and YES tell your lawyer the situation.

        You may want to hold off your bankruptcy filing until you make sure everything is in "perfect order". One slip and your case will be dismissed and you will have to wait six months to file again with a limited automatic stay.

        The old law if you slipped, a pissed off trustee would just grant a continuance. Today a forgotten "anything" will be grounds for dismissal, no exceptions.

        No need to panic since you did not file yet just tell your attorney and get EVERYTHING in order.
