    341 Meeting is Tomorrow!

    I'm getting nervous as I wonder how this 341 meeting will go. I don't have any assets, but what I am worried about is my income tax return $$. I filed last month and got close to 4k back. My $$ was all spent on attorney fees, court fees, and car repairs. I have receipts to prove it. Does anyone here think I should be worried about this?

    I went through Chapter 7 two years ago. We got our refund in March and our 341 was in June. They never even asked about the refund. I hope yours is the same way! If your 341 is anything like mine, it'll be over in about 5 minutes. Most of which was spent with the trustee checking our IDs against the paperwork. I think the trustee only asked us one question and then we were out of there.

      Don't sweat it, ours was a chapter 13 but there were 7's going in before us and nobody took over 5 minutes. It is one of those things you dread but is not nearly as bad as you think it will be!

        sand77 - our 341 was in May of 2005 and lasted about 10 minutes. We filed and received our income tax refund in February and of course had it spent for bills, fees, etc. The trustee asked us if we had gotten it and if we did what we did with it? No big deal. 13inOr is so right...all of us had panic attacks about our 341 meetings and after it was over what a relief...it will not be nearly as bad as you think...Good luck...

          My atty stated in my bk petition that I did get a refund this year but it had been spent on atty fees and bills. He said that usually does it. He explains everything in the petition. He said if you are really prepared the trustee doesn't question too much. The 341 is what I'm dreading the most also! We will be filing next week so one step will be over with, then the 341, then we wait!!

            Good luck at you 341. Trustee seemed like a rather kind individual, and didn't talk down to anyone. He was very direct and to the point, Things wwere over before we could catch our breath.

              Yeah, my Trustee SEEMED like a kind individual too, THE WHOLE TIME HE TOLD ME HE WAS SEIZING MY HOME YOU COULD $$$$$ IN HIS EYES...........

              Your 341 should go fairly smooth, most do...

              I too used income tax refund to pay attorney, trustee said nothing but OK.....

                Had My 341 This Morning!!!

                Thank you all for your positive responses. My 341 went very well. I was there for about three hours before they called my name. I was so nervous, but the trustee seemed to be very kind. What I did notice was that he would ask more questions to people who had more assets or who were business owners. I live in Los Angeles, so it was pretty interesting to see all these different people. This guy who went up before I did was acutally a musician, and he was still receiving royalties from an album his band made three years ago. He was receiving approximately 6,500 per month. He was filing bk for owing back taxes. The trustee seemed interested about his particular band, he kept asking him questions about what record label they were with, the name of their band, and what type of music they played. They played alternative music, but i forgot the name of the band.
                The whole thing was just weird, watching all kinds of people. But like I said, it all went well when it came to me. He just asked me the typical questions he asked everyone, took a quick look at my tax returns for 04 and 05, then he gave them back to me and said "I have no further questions". It only lated about 2 minutes!

                Although it's not completely over, you guys have no idea what a great relief I feel today. I'm all smiles!!

                    See, nothing like you thought it would be, huh!!!!

                    Now sit back, don't panic the next 60 days and wait on that discharge.....

                    Hopefully no creditors will object..... most don't (cost them too much)....
