    How can you be sure that you listed all of your creditors?

    Hi:

    I plan to file BK shortly (Ch 7 - No assets) and I have generated a list of all the creditors that I know that I owe through the use of old bills I may still have, current bills that I haven't paid and through the use of my CR's. But how can you be sure that you have all the creditors listed? What if one of your accounts is about to be turned over to another CA you have no idea about. They could claim that they never received notice of your BK?

    I know that if you are a no-asset case, it doesn't matter what creditor comes out of the woods after the discharge and closing because there was no money to distribute to other creditors anyway.

    Any thoughts?

    go to www.annualcreditreport.com and print out copies from all 3 agencies. This will give you a list of all creditors on your report. It won't give you a list of other types of debt your trying to exclude...medical doctor bills, most landlords, ect..

      There were also a couple of items that had dropped off my report that companies were still trying to collect. If you have copies of the collection notices refference those as well to be sure you have everything. If your going to do it, you might as well stop the calls for items that no longer appear as well.
      My credit scores:
      Before Filing: Tr 496, Ex 496, Eq 507

      Today: Tr 618 (+122), Ex 601 (+105), Eq 623 (+116)

        The paralegal that works for our attny said to keep any and all correspondence we got from Creditors and pass it along to their office as well. She said the attny uses every address he gets for each and every creditor so the creditors can't use the "I didn't get proper notification" defense.

        When you look on old CC bills, there's at least 2, if not 3 addresses on a CC bill. The address to mail payments to. The address to mail billing disputes to. Sometimes there's an "other correspondence" address as well. And the letter's we've been getting from the CC's have a different address than the statements. And, the credit reports we ran at the website listed above had even different addresses listed there as well.

          Did the atty list the same creditors but with multiple addresses on the credit matrix but not on the same schedule (F) with the amount of debts? Some of my CR's have the same creditor that's owed money to but different addresses are reported. How can that be?

            Following someone else's advice here...I prepared my creditor's list by:

            1. Getting a copy of my free reports from each bureau.
            2. Going through MONTHS of unopened mail from creditors, collections agencies, etc.
            3. Made up a list for each and every one. If there were multiples, such as where the OC sold to an agency, they BOTH got listed (my attorney's advice). I have a computer and used a spreadsheet to list them in so they could be sorted easily (and totalled).
            4. Every day, added or appended to the list. Once I knew I was filing and had an appt with my bk attorney, I started answering the phone happily and informing them "I am filing bankruptcy on this - pls stop calling, and here's my attorney's name and number".
            5. On some, I called to get the correct address. Took the time to let them know I was filing...the slobs on the phone don't care...once I informed them I was filing they willingly gave the address so their company could receive proper notification. Not a single one of my unsecured creditors filed an objection!

              I don't know how it's gonna go on the Creditor's Matrix, SoBB. Just relaying what the paralegal said. The attny will send a letter to every address we have available for every CC. She said that's to avoid the, "We didn't receive proper notification" comments.

              Also,.......... We're out in nowhere'sville. This Court is. The paralegal said they've never had an attny from a major CC show up at a 341. Local Creditors is a different story. If we'd bought something from a local furniture store, or a local car dealer, we would see those Creditors at the 341. But we don't have any of that, so she doesn't expect we'll see any Creditors at all at our 341.
