    What Happens After The Discharge In A Chapter 7

    I Need Some Help. I Filled Bankruptcy And Went To The 341 Meeting There They Told Us They Wanted A Copy Of Our Tax Returns. We Then Recieved A Letter Saying We Have Been Discharged. So We Thought That Was The End And Did Not Swnd Them This Years Taxes. Is There Another Step After You Have Been Discharged??? Our Lawyer Has Not Helped Us At All And Now We Have No Idea What Is Next. Please Help!!!!!

      Hi RC

      Our case required we surrender a percentage of our tax refund. We were discharged in January, but, per a December letter from the Trustee, still had to forward copies of our returns to the him and after he saw the amount of our refund he wrote us a letter explaining how much we had to give to him and why.

      We wrote him a check out of the grocery budget ( :-/ ) and sent it to him before we even got our refund checks, just to move things along.

      Then he decided he wanted some of our non-exempt assets (paltry stuff, like garden tools, CD player, etc.) We had to make him a monetary offer to "buy back" the stuff, or else surrender it to him. We ended up making an offer because it was easier than shopping for new little by little over time, and we are waiting to see how that's going to work out. He accepted it, but our BK lawyer basically told us to jump off a pier unless we could come up with $400 - $500 more dollars for the joy of having him bungle up this part of our case too! So we are trying to deal directly with the Trustee, but it's slow going. We recently sent him a letter advising him that we've received both our tax refund checks (which we can now use since we paid him his portion of our refund out of pocket weeks ago) and that we were ready to remit the payment for our assets to him whenever he likes. Haven't heard back yet.

      Meantime we're in limbo.

      So you see, a LOT can happen AFTER your discharge, BUT at least it means you won't have to pay back the creditors, even if the Trustee does take your garden tools and lawnmower !! LOL

        I would have called this trustee's BS bluff and offered to bring over the piddly lawn equipment, CD Player, etc.. that very afternoon. Just seems pretty petty on his part and I have a hard time believing that he really was interested in having to deal with selling them all off. He was most likely fishing for you to give up some cash by offering to buy them back. Which you fell for hook, line, and sinker...

          I wonder if the US Court Officers would let you haul that into the room; that would be quite a sight! I enjoyed watching the Court Office put my 15 pieces of stapled paper thru the scanner yet not my wallet.

            When the Trustee requested a copy of your income tax return when you filed it...........that's what he wanted............. and you did not give it too him..........
            NOW, he can reopen your case, it could be dismissed and you owe all your debts again if the Trustee sees fit to do it.

            Best suggestion that I can give you is RIGHT NOW:

            Send the Trustee a copy of your income tax return you filed this year. And do it now................

            If you have received a refund - do not cash it...... if you have, make sure you keep enough money around to cover it....

            After the Trustee makes his determination whether he wants any of that income tax refund or not, then you are free to do with it what you want.

            Don't take a chance on getting your case DISMISSED... send him what he asks for.

            You case is probably just DISHCARGED - BUT NOT CLOSED.......... since the Trustee asked for the tax return.

              Yeah, that Trustee wants the tax check. We were told basically the same thing at our 341. Just mailed our 2005 Federal tax check to the attorney. All 3100.00 of it just for the Trustee. Hope he has a nice night our on our tax return! (Don't really care what he does with the refund as long as he closes the case pronto!) Does anyone know how long it takes after he gets the refund?

                Put on your PATIENCE PANTS and have a seat..... No Trustee gets in a hurry when closing a case if there is money involved.......

                  Do I Just Send Him The W-2 Form Or A Copy Of What We Filled???

                    You send him a copy of your Federal return and state return that your filed. Wouldn't hurt to send him a copy of your W2 also because he will probably ask for it too.... they don't like gross figures.
