    Just got Certificate, file now or later?

    Just got my pre-filing certificate today. I have to pay $500 retainer plus $299court costs to my attorney tomorrow. Only catch is, I wont be able to pay my mortgage payment by the 15th. I will then be 60 days late. I told my lender i would make one monthly payment by this Friday.
    Do I cancel my attorney appt and pay the mortgage and file with my next paycheck on the 30th???
    No matter how u cut it, I dont have the money, so I figure just do it and get this underway...advice pls. Thanks in advance!

    Depends,...............

    If you were hoping for a Ch 7 and wanted to keep your home, you couldn't with payments in arrears.

    If you're planning to file Ch 13 anyway, then pay the attny and don't worry about the house payments. The Court can include your arrears into your plan payments.
