    Reporting on non-reaffirmed loans

    My BK7 was discharged in January. I have a home and a car that I have retained and have continued to make payments, though no reaffirmation was done.

    I'm in credit rebuilding mode and am disappointed to find that both creditors are not reporting my payment history. In fact, some of the payment history is incorrect and showing charge off in one case. I began by disputing the accounts through the CRA's and they came back as verified. Now I've contacted the creditors directly.

    Both creditors sing the same song, that the account was included in bankruptcy and I'm stuck with what they've reported. I maintain that they are reporting incorrect information on my payment history based on the FCRA. I never missed a payment ever and maintain the accounts should show Paid As Agreed - because that's the truth!

    Am I beating my head against the wall? Any suggestions on tactics I should take to help them see it my way?

    I could probably refinance with other companies, but the car loan is 3.9% and the mortgage is 6% and I know those rates would never happen.

    As best I can determine, if you did not reaffirm then the accounts were included in the bankruptcy and they are not supposed to report payment history after the bankruptcy. It doesn't seem right that the accounts would show as charged off though, since you were current when you filed.

      Here's the deal: If you didn't reaffirm, that means at any time, you could stop making those payments, and completely walk away from the loan. Therefore, your creditors are correctly reporting the info on your credit report.

      If I were you, I would at least refi the mortgage (rate and term only) and get that to be reported again ASAP. You are shooting yourself if the foot the longer you wait.....

        Dang, in my mind I was thinking that by them reporting no payments it would be considered incorrect information under the FCRA.

        I wonder: if the trade line shows Derogatory, does it even make any difference in my scores if the payment history shows correctly, as a charge off or included in bankruptcy, etc?

        Thanks for your help. My first (and only) BK and I'm learning as I go.
