    Am I getting close?

    Hey all-
    Maybe you all can help. We are currently waiting in limboland. We have been discharged (yeah!) but not closed (boo!). We had to forward our tax refund to the trustee, then had to wait for the deadline to file a claim for our refund (a whole whopping 800 dollars! I'm betting that no one but the trustee saw much of that money!) which was 3/20/06. We did get a small amount back, for which we were grateful. Check was cashed beginning of April. So I am thinking that it should be about time to get this case closed, right? No other assets to speak of. Well, today I saw on Pacer a notice of intent to submit the final report! Please tell me that this is a good thing? I'm hoping that means that soon, we can go back to our regularly scheduled lives? I would love some opinions!

    On the plus side, living debt free and on a cash only basis, is very freeing! We will NEVER go back to our old habits!!! This long wait has only strengthed that resolve! Maybe the trustee is doing us a favor...nah, probably not.

    I'd like to tell you YES Wendi, but I'm on the flip side. Been thru learning about BK, got our Cert, our attny, docs turned in, and waiting to file the petition.

    Sounds like you're about to close, but I can't say for sure.

    Maybe some one else will chime in.

        TY for the thought, Wendi!!

        Maybe if you don't see a change on PACER toward the end of the week next week, you might call the Clerk of the Court and ask nicely about it. Sometimes it's just a housekeeping issue and a phone call is just the nudge needed to get the filing done and your case closed.

          I think the Trustee extends, as he did in my case, some deadlines wothout notice and then closes the case once it is beyond any reasonable time limit to object. Our closing was six months beyond discharge, and the deadline for objections extended for some reason 5 months beyond discharge but without any letters going out all over the place. I found the extensions on Pacer after the "case closed' showed up.

          In general there is always a reason for the case to close later.

            I would say your "closed" is coming shortly......since the Trustee has notified the Court of his intent to file final report......

            Sit tight, be patient - I do believe it's on its way...........

              In the same boat here. Sent our tax refund to Trustee around the end of March. Case still isn't closed, and we've not gotten our part of the refund yet.
              I am waiting paitently and will be sooooo grateful when this chapter of our lives has ended. We are now on day 236 since filing. I've acquired a few gray hairs since this all began, and know how anyone must feel who waits seven months or longer for their case to close. Just curious Wendichris, how long after you sent the check to Trustee did it take for you to get your portion of the refund?

                I was reading somewhere where the trustee in my district has a certain deadline each month for receiving funds (like the 10th of the month or something like that) then those funds are paid out near the end of the month. Anything received after that goes toward payment at/near the end of the following month. Whatever that day is, who knows. Fact is, trustee bascially has it set up so he can keep money in his account for a good amount of time. I am sure this has to do with making sure checks clear before releasing funds....perhaps your tax return fell into that same time frame snatch, and you might see something end of April.
