    terrified about 341 tomorrow

    Our 341 hearing is tomorrow at 9:30am. We're going to surrender my vehicle (didn't qualify for 722 redemption and couldn't get a 722 loan) and we're hoping to reaffirm my husband's truck. However, we haven't signed a reaffirmation agreement from our attorney yet so I don't know what this means...and the blasted attorney won't call me back.

    Anyway, I'm prepared to live without a car for a short while but how difficult is it to get financing for another vehicle after the bk is discharged? And am I responsible for any missed payments (time of filing to time of 341) on the car we're giving up?

    I feel completely out of control and I hate that! Any help or advice?

    and what do you wear to these things?

    I can't help with the car issue, but the wardrobe is another thing!

    We wore jeans and a nice shirt. Nothing fancy. Our atty told us not to dress up at all. When you get there you will realize that nobody is dressed up! Don't sweat it, it'll be over before you know it!

        thanks for the wardrobe advice and calming words... now if I could just actually get calm.

        has anyone been able to finance a new (used) car after chapter 7?

          bonnieb, you will be fine.. I am sure that you will walk out of that place saying the same exact thing I said and that was "it was nothing like I thought it would be". Probably 5, maybe 10, minutes with the Trustee and you are done..

            Regarding the auto - be sure you bring it to the attention of your attorney and the Trustee that one you are surrendering, the other you are reaffirming on.....

            Under the new laws YOU must contact the auto dealer about the reaffirm and surrender issues on your vehicle and YOU MUST DO THIS BEFORE DISCHARGE DATE..... Be sure these papers get signed before your discharge date on the vehicle you plan on keeping. The other will be surrendered at a later date, don't make any more payments on it.... but keep your payments current on the one you plan to keep....

            Stay calm,,,,, 341 will be over and you will be amazed at how easy it goes..... unless you really have a lot of issues to deal with!!!

            Dress casual, comfortable, leave off the GOLD and DIAMONDS!!!!

              You all were soooo right! It was over practically before it started and was painless. Now I just have to take care of the reaffirmation of my husband's truck, the surrender of my car and deal with getting a replacement car (any advice on that???).

                told ya... glad it was a painless process for you.. Now, keep yourself VERY BUSY for the next 60 days to make it go by quickly..
