    please..help !!

    I have found this great forum today and after reading many different threads, I've decided to post my question for some help. My attny is getting ready to file my bk 7 and he told me it will be done for my review within next few days..
    so far, I had screened all the calls from collectors and it has been about 4 month since I made my last monthly payments to them. My question(s) is.. my attny has given me the special contact number for the creditors to call but is it better to keep ignoring the calls until my papers are officially filed and let them know?? or just tell them to call that numer from now.. and I would like to know about how long does it take before the creditors can sue me. All of my debts are unsecured and I really want to get this done before it gets more worse.. Thank you..

    I'll tell you my experience. We have some cc's that we haven't made payment on in years - 3-4. Yes, I would definitely give them the number your attorney gave you. They won't call you anymore. Even better, send them a letter with the attorney's name and number and tell them what you are doing. If you are that close, within 1-2 weeks, I (this is my opinion), would answer the phone, give them the attorney's number, and let the process notify them. And get some rest, everything will be ok.

      If you gave the attorney money to file the papers, and he gave you a number to have the creditors call, I would say that you should wait until you sign your petition for bankruptcy. Once signed, then give them the number.

      Some credit card companies won't leave you alone until the papers are filed, so I wouldn't answer the phone until you have signed the petition and know that the lawyer filed it for you. This way they can't call you again once the petition is established.

        Titan is exactly right...a lot of creditors will not accept just an attorney's number...they want the case number because that actually proves it is a done deal. I would wait until I had the case number. I told the few creditors that called me my attorney's name, etc., and it did absolutely no good. And try and be calm...filing BK is stressful but it isnt terminal.

          Isn't it a violation of the law for a creditor to contact you after you have told them to refer all matters to your attorney. I think I have seen that somewhere. If so, if someone keeps good records, I think the fine is like $1000 per violation. It has nothing to do with the automatic stay, they can still try to collect, they just can't call you directly. I'll have to see if I can find that somewhere. I'm just thinking out loud right now so don't take this to be accurate, I am just going by memory.

            It's a mixed bag. Who keeps calling you and who updates their records and quits.

            Some will contact your attny to see if you're really filing or not. If you are, they'll update their records and quit calling.

            Others have a policy that they will call regardless, right up to the day you file.

              As soon as I finished paying my atty I started giving the creditors his name and number and never received anymore calls again. Only one wanted to know my file number. I was able to provide it for them after checking pacer...I hadn't received the actual paperwork in the mail yet! It is so nice to not be afraid to see who's calling!! It is like torment.

              I am just sailing thru my 60 days...1/2 way home now! Life does get easier, I can actually breathe everyday and not worry!
