How long until we have to vacate?

    Hi Everyone:

We just received notice that the foreclosure process will be initiated if we do not pay our last 2 past due payments by June 14, 2006. My question is: How long do we have before we will be evicted??? I am fairly certain I have an apartment lined up for August 1, but I can't move earlier. Will this be enough time?

    Thank you,

    Concerned

    hope this helps

Length of time depends on your state and their redemption periods, if they have a redemption period. Do a search on yahoo or google for your state and then redemption period and that should help.

Generally you can stay in your home without paying anything until your redemption period is over and then you lender can start eviction proceedings which you may want to avoid. You can find more eviction info by searching as stated above.

I live in Ohio. A guy two houses down from me was forclosed on. The forclosure was ordered by the court in May 2005. The Sherriff JUST posted the notice on the door that they had until June 3, 2006 to get their stuff out before the house was seized.

So that means they went 2-3 months without paying before May 2005, then stayed in the house rent free for almost a year.

It takes a LONG time to get forclosed on. Sheriff Sales, the deed has to change hands, the title, etc
      Date Filed: 12/19/2004
      341 Meeting: 2/8/2005
      Date Case Confirmed: 7/12/2005
      Closed on Refinance/Chapter 13 Buyout 8/23/06

As others pointed out, it's a state by state thing. I know of a couple of Il. residents that stayed in the home for 8 months before the eviction.

I live in Ohio too and my last mortgage payment was in Aug.05....10 months and still counting until foreclosure. Although, we moved out of the house in Mar.06.
