    Tax Returns & the Trustee

    We just have received our discharge papers. We filed our taxes on 2/3/05 and our expecting a return. Is the Trustee entitled to it? What happens if I don't give it to them since the bankruptcy has already been discharged? I thought that once it was discharged then that was it. Also my attorney is a slacker, we just got papers to reaffirm a credit card that was in good standing that they took upon themselves to put in the chap. 7. Since it has already been discharged, can I still reaffirm the account? Thanks!

    Why bother re-affirming the account?

    You must give the Trustee your tax returns. Although for all intents and purposes, the discharge is the last step in BK, it doesn't mean its the last thing you have to do. If you fail to comply, i.e. don't turn over you tax returns, the trustee can overturn you discharge.
