    Post BK call

    Greetings, all.

    Perhaps it's the creditor in me, but I got a voicemail today from my mom (who lives in Ohio) that some chick from an un named agency called her, leaving her name, phone # & a ref #. Stated if I didn't call her by 4pm (yesterday) that legal action would be taken up.

    So since my cell phone was off, I didn't get the message. So I called the number today (can't find anything on it to figure out who it is) and the automated machine states to leave a message (again, no company name.) I left the following message:
    "Yes, my name is lostsoul23. Your agent, twit, called my mothers home in Ohio and I live in another state. She made a threat of legal action. This is my reference #. I would like you to know that I filed Ch 7 bankruptcy, in Ohio, in Oct 2005, case was discharged Feb of 2006, and closed March 2006. Also, before making anymore threats of legal action, be advised of the FDCPA and the violation that is. If you need to reach me, call (insert prepaid cell phone # that is never on.) All debts that were owed by me were included in that chapter 7 and nothing new has been incurred. DO NOT call my mothers house again."

    So naturally, I'm so beyond upset. I'm ready to rip this woman's head off. I'm expecting a nasty call on Monday at which point I'm going to nail her for the FDCPA violations.

    The question is, fellow board members...anyone have any clues how to find what a # belongs to? I know it's in Irving, Texas and that's about it. I want to start the ball rolling with a report to the BBB, and nothing came up on their site when I tried to search by the phone # there either.

    Did you try 'Googling' the number?

    Open Google at www.google.com , put the number with area code in the Google search box like this - xxx-xxx-xxxx - and press Enter. Look at the top of the screen for Phonebook Results.

    Hopefully this will bring up the owner of the number for you. It's worth a try - good luck!

        I was thinking the same thing, so since I've been working on cleaning up my reports I pulled out the most recent addition and have a winner...I think. Same area of Texas, and it's one that a internet payday loan hired on. My mother says she wasn't even going to take any info from them until the woman made threats of legal action and she got worried. I can't wait until Monday...if she calls me back I'm going to let her have it, and remind her that's its a violation of the FDCPA to threaten legal action without intent of going through with it, I'll refer her to the court disctrict that my BK case was done through and then tell her to sue me or bite me.

        I did "Google," the number as well and not much luck either. It hit on the area code which is how I found out what area it was out of.

        Oh I can't wait. Once I get the full scoop I'm going to post it here. I made sure to include every single debt I owed when I filed, I wasn't going to go through that entire mess only to miss something.

          Just a quick update -

          Monday came & went, no calls. Nothing has been filed (checked the clerk websites for the county in Ohio I lived in & the one here in TN.) I'm thinking my second call on her voicemail may have done the trick, I don't know, but if anything comes of this I'll let you guys know.

            Well, low & behold she called my mom's again yesterday, and this time made a direct threat, on her answering machine. I called her back, told her I left all the BK info on their after hours machine and she quipped, "we don't check that," and I told her "not my problem." I went on to tell her again that I don't live in Ohio, she claimed I put my mom's # on the orginal application (not true), etc. Needless to say, some words were exchanged and I've filed a complaint with the FTC.

            Curious - what kind of liability am I exposing myself to if I list the name of the agency here?
