    Happy Camper! Can file Ch 7 and Keep the House

    I just got done with the realtor doing the market evaluation. I felt so bad bringing them in on the premise of selling knowing how much work they were doing to prepare. (Ironically, I had pulled just about the exact info they had).

    It was a really nice couple that worked as a team of realtors. They came in at $154K--if a trustee allows 10% for cost of sale, I'm under the homestead exemption by about $2K; with 7% cost of sale, it's about $1K over. I don't think that any trustee will want to go through the trouble of trying to sell a house that floods in the basement to get $1K out of me.

    OMG, I've been dreading this--I slept 3 hours last night. It's all I could think about all day--I didn't get any work done.

    I can breathe easy now--I can file Ch 7 AND keep the house.

    Now, all I need is enough money to file. LOL

      Woo hoo! Great news for you, anon - you must be so relieved! One more thing to check off the long bk prep list - now you can catch up on your sleep tonight.

        One of the people in the townhouses must be in the same financial boat as I am in--they just dropped their house $30K!! I feel bad for them, but that helps me to show trustees that NOTHING is selling.

        I worked so hard to put down 20% of this home when I bought it. The attorney kept acting like "no big deal" if I lose the house since I would be able to walk away with $45K. He just didn't get it. I was scared of having to get a place ready to show, to pack, to move, to where? And then there was no way that the rest of the family would find out. I'm not sure which part scared me more!

                So happy for you Anon. It's great when you can keep your home. Especially when you have put so much into it. And good luck scraping up the money to file your BK. Seems like for us, everytime we get the majority of the money, something comes up and wham, we have to push it out another two weeks. We are now looking at mid to late July instead of early July.

                  I get paid monthly so every time I can't do it, I have to push it off another month. *Yikes* Gotta put more stuff on eBay and have another garage sale! I'd love to work Sat and Sun for a month somewhere, but that would put me over the median income!
