    Motion after Discharge---How can this be?

    This is my first time here and I hope someone has some helpful information. I converted my bankruptcy from a Chapter 13 to a 7 upon the advice of my attorney.

    I fulfilled my obligation of making Chapter 13 payments to the court for 3 years when the Trustee sent me a letter demanding my tax returns (3 years). I did not realize I had to turn over my returns and had used them for medical expenses, I was diagnosed with cancer and did not have insurance at the time. I did not have the money to pay the three years of returns.

    My attorney suggested I convert to a chapter 7, which I did. I was allowed to file under Chapter 7. After several months the Bankruptcy Court finally granted me a discharge. I received a letter from the court but the Trustee filed another motion.

    I received another letter from the Bankruptcy Court which stated I had been discharged. Several months later I get another letter that the Trustee has filed another motion to collect my tax returns.

    Even after my Chapter 13 was converted to a Chapter 7 and the courts discharged it, can the Trustee continually file a motion to collect my returns? Has anyone out there have this happen to them?

    Not to be brusk, but send them your friggin tax returns already....!! You are shooting yourself in the foot.

    This should have been explained to you at the outset, but YES, you have to send your tax returns during the ENTIRE pendancy of a chapter 13, and for the 2 years prior to the filing of a Chapter 7, and in some instances, the same year as the chapter 7 was filed.

      How do you pay, what form of currency do you use to pay back 2 years of taxes and even the same year taxes when you don't have blood in your turnip? Do you file. Have no assests. Get discharged then have a "future tax" debt. I'm confused? If I had last years return or even this years, why would I even be filing in the first place? I know I may sound scarcastic, but I really am asking. Cause I have yet to just plan and simple get a comprehensive answer so I can stop pestering forums. Do I just forclose, file for unsecured debts, give back the car and go live in a refrigerator box? If that is the case, then what IS the bankruptcy code. And who should use it?

              Why allow yourself to get a refund at all????? Amend your witholding so that you pay 100.00 - 200.00 per year. This is not a "forced friggin savings account".

              It costs the Government to administer these refunds and for years they have been toying with the idea of penalizing people who get back over a certain amount.

                RE: inheritance after chpt 7

                I filed chapter 7, in April of last year 2004. Now, I have just found out that I am to inherit some money from my mother in law. I had my husbands will probated, which now leaves everything to me. It was mine anyway. I was sued for $500,000.00 because of a car wreck my son was involved in. I didn't want to lose my home or land so I filed chpt 7 bankruptcy. Now I find out the court is wanting to take the money to pay the attorney's, creditors, I didn't have any but the party who sued me. The money is around $45,000.00 I don't feel like I should give them anything. What should I do?

                  I was never told to send tax returns or refunds. I even called the lawyer and the trustee with some questions about my taxes and neither mentioned sending anything in.
