    Changing mind about a car reafirmation

    Ok, we filed chapter 7. Its not been 60 days yet so its not finalized. We have had a major run around with the car company. We wanted to reafirm it, but have now decided to give it back to them.

    We filed ourselves.. What forms do we need to file to do this?? Anyone know???

    We cant get any answers from the bankruptcy court.

    Did you sign a reaffirmation agreement with the lender? If not then turn the car in. If you did, you have 60 days with which to decline the reaffirmation agreement.

    The court would have to approve the reaffirmation agreement before the discharge anyway. Has this happened?

      Well, we never signed anything because they never sent it.. We had planned to and told the court we were going to when we went for our 'meeting'.. But, its been over 30 days and we still havent gotten anything from the car company so we went and picked up a used car cheap.. THEN the next day we get a call from them saying they are going to send it.... I dont want it now!!

      I just wasnt sure if I needed a form or if we just send a letter to the court?

      So we just turn in the car? What paper work do we have to file? Thats what Im worried about. The court wont tell us anything. They just say. ."thats why you should have used an attorney".. urrgh We couldnt afford one!!

        Contact the lender of the car directly and see what steps you need to do to turn in the vehicle. If you listed them in the bankruptcy and did NOT sign the reaffirmation agreement, the debt will be included in the discharge.
