    Things Trustee can do after your case is discharged?

    I just thought of a good thread, anyone want to share some of the things they have been through with the trustee after your case is discharged. My case is discharged, but the trustee is still "administering" the assets.

    Wenderful, reminded me that a rule 2004 exam, can't come after case is discharged. For myself and to the benefit of others love to hear what people have experienced.

    Rip off

    doesn't make any sense if your case is dismissed its over and should be closed by the clerk handling it. Your probably being ripped off. Get a subpeona off the courts website and issue it on him for all financial records regarding your case and file it with the court. That usually blows their minds cuz most are so stupid that they don't understand that in America "USA" no person is supposed above the law even if they work for the department of justice. You have to be ready for retaliation so if you can't hack the pressure just vent on the internet and join a third party like the libertarians or something like that.

      No, they have to complete the disharge by so much time, don't know all the dates. Administering the assets is a different story. I have watched my trustee with other cases, and he is always doing asset administering after cases are dismissed.

        Okay - learners!!!!!

        There is a big difference between dismissed and discharged...................

        Dismissed means your case is cancelled, closed, voided, etc and is over - no assets involved...... nothing done regarding your case.

        Discharged means your case is discharged (60 days after 341 meeting) except for the payment of the creditors (assets).... After the creditors are paid (up to the Trustee, and believe me they drag it out), then and only then can you case be closed......

        example: my case - discharged 18 months ago, case still open and pending (624 days) because the Trustee has not completely paid the creditors yet.... and acutually my case has been open for 760 days approx since the day it was filed.

                The judge called for a hearing in August wanting to know why my case has not been closed (wonder who arranged that, lol???)....
                Now the Trustee is in a "rush" to pay the creditors.............. before he has to go in front of the Judge...... he's trying to get them paid and get the case closed......

                Actually my case has been open for 760 days now since the day it was filed.....

                Yeah, he's figuring I'm gonna sue and wants some of the cash......

                  Yep as long as my case is open, he can dip into my pockets for any extra that I may get........ inheritance, lottery, lawsuit......

                  Now if my case was closed he could still reopen it up to one year...... if he found anything worthwile. But also he would have to petition the court to do it....

                    Yep, kind of "tee's" me off real good too........... makes me wantta go after him even worse...........

                      Hopefully,

                      When I'm thru with ALL THE PEOPLE INVOLVED with creating this problem for me.......... including bank, mortgage company, title company, my attorney, and the Trustee....

                      I will have my home paid for, a new car in my driveway, and a little nest egg for retirement.............

                      Facts will standup in Court and these people screwed me over.............

                          Since I repurchased my home back from the "buyer" after the auction (I was so lucky that they sold it back to me - and thanks to friends I was able to buy it back)..... just like buying another home......

                          I don't think the Trustee can touch it now even if it does have equity in it...... not the way it is set up at the present time.....
