    Hard Credit Pull from Bill Collector.....

    I have a question....so I got sued by the HOA of a home I used to own, long story short the telephone carrier out here Qwest decided it was a good idea to drop a line from the tap which was right in my front lawn and run it across the entire length of the front lawn through the back lawn into some new homes they were building behind me. The HOA didn't like the line there and sent me a $50 fine and told me that it didn't belong there get it out (like I could seriously do anything about it or asked for it to be put in!!!!). Paid the $50 fine and got a $100 fine the next week. Called them back explained the same thing (called the PUC at this point), paid the stupid fine. Got a $500 fine the next week and refused to pay it. The line was on an easement and per the PUC they couldn't do that. Well all this time I'm in and out of the hospital and I got really sick and had to be hospitalized for about 2 months.....long story short, they sent a letter that they were suing me and to appear in court one week too late. So I got a default judgement entered against me for about 1800. I didn't have the money to pay it and the house was going to foreclosure because I wasn't working. Anyway, they got the judgement and all but I pulled my credit report and I show a hard pull on 10/2005. Can they do that? I never authorized them to do it and at that point I started making payments to them.

    Collection activity is a permissible purpose to pull a report.
    They don't need your permission.

      Public Utilities have a right away only if easement is granted by the consumer or it is Court ordered as community improvement......

      If you had phone lines installed and gave them permission to cross your property then the phone company is not at fault.

      Also if your HOA does not allow such access without their approval.... then you have messed up by granting easement.

      And they do have the right to fine you...... tell you to move it......

      Many a waterline has been made way out of its direct path due to the lack of an easement and I'm sure the cable, electric lines have the same problem...

      Contact the Qwest carrier and tell them the situtation and that they need to re-route thier line.....

      Also they do have the right to pull a credit report if they are a collection agency..... or a HOA.......

        Nope I didn't give them permission. I came home one day and there it was. I called and called Qwest. It was put on an easement. I didn't have a choice but to give them an easement......every single piece of property had an easement in that community.
