Just curious. When can I expect the dreaded calls to stop? Does it depend on how soon my lawyer files my papers?

When do the calls stop?SILVERLADY 02-11-2005, 08:08 AM Just curious. When can I expect the dreaded calls to stop? Does it depend on how soon my lawyer files my papers? HHM 02-11-2005, 08:35 AM They should stop within about 10 days after you BK is filed. If they call, you should be telling them that you are represented by an attorney for Bankruptcy and give them the name and number of your attorney, then hang-up. Chris 02-14-2005, 08:32 PM If you say that you are represented by an attorney does that force you to actually go through with the filing immediately or do you have more days to get your paperwork togther and research about bankruptcy is? Or is it once you say you have and attorney that a motion must be filed within XX amount of days? Or is it once you say you have and attorney that a motion must be filed within XX amount of days? If you say you're represented, you'll need to provide them with the name and number of the attorney. If they determine otherwise after verifying this information, they'll typically resume using telephonic collection attempts. Chris 02-15-2005, 06:45 AM I gave them all the attorney info, and was asked what chapter I filed. I said nothing has been filed. just contact my attorney for any info on me. They tried to get more info out of me like has my attorney been retained, do I think I'll be going 13 or 7. I said I can not say anything else, please refer to my attorney. Well, they have taken down my access to the online credit card account. I haven't even filed anything. How is it not harassing that they don't allow me to see my charge history, payment history or any future fees and rates attached to my account before it is even filed, or even discharged? I am so upset that there are no check and balances for what they are allowed to do. If they are going to charge fees to an account that I have, I have the right to access the activity, don't I??? Again nothing has been filed. HRx 02-15-2005, 10:25 AM I gave them all the attorney info, and was asked what chapter I filed. Again nothing has been filed. How deliquent is the account? It isn't uncommon for creditors to "cancel" an account that is several months deliquent, and or once they've confirmed that you've retained counsel for BK. Just contact the creditor and tell them to mail you the information you need about your account. robivi3 02-15-2005, 01:11 PM Everyone took down my online access once they got in touch with my Attorney. They can do that, online access is not a right. | |
