I filed for chapter 13 Dec.16 and at the time I had a business failing. The lawyer said my income was too high for a chapter 7. Has anyone else heard of this. I was struggling to pay my bills then and still.

I'm no expert, but we were told the same thing from the first atty we visited. I would suggest going to another atty for another opinion ... most offer a free first visit to discuss your options. The second atty we met with had us in his office for approx 2 hours going over all options. He told us that while our income was good, we do have a significantly high monthly budget that leaves very little disposable income. He suggested we file Ch 7. If you can prove your expenses are necessary, you shouldn't have a problem filing Ch 7. However, as my atty stated it's really up to the Trustee to approve your "budget plan." We are filing for Ch 7. If Trustee disapproves our budget, we plan to convert case to Ch 13.
