Joint tax return and refund

My husband works and files our tax return.My name is also on the check,I just went back to work in order to pay for my chapter 13,will the Trustee take our return,no debt was in his name,mine only,thanks

It depends, the trustee may take a portion of it. If your in a community property state, the trustee will likely take half.
