Hi there, I have a complicated question. I should probably call a lawyer but don't have enough money to do that.
In July of 2004, I was rear-ended in a car accident. I went to the hospital, and all the bills from that day came to $1,900.00. Since it wasn't my fault, the person who rear-ended me's insurance company said they will send me a check for it.
I filed for bankruptcy pro se on February 5th,2005, with $0.00 in my bank account. The check from that accident came February 11th, 2005 and I deposited it into my checking account leaving me with a balance of the exact amount of the check. I did not claim any of the medical bills from that accident on my bankruptcy petition because I was going to be reimbursed for it. I still have the money in my bank because since it is a out of state check it doesnt clear until Monday, February 21. I just sent my taxes in, I will be getting back $670.00.
My cat is extremely sick and needs emergency surgery costing $700.00.
The only solution for helping him that I can think of is, using the money that is in my bank account that is meant for the accident bills then when I get my tax return back, use that money to pay the accident bills.
How will this affect my bankruptcy and what would trustee think of this!?
If my cat doesn't get this surgery, he will die and I can't bear that.
I would have my bankruptcy be denied after using the money then not use it to save him.
