    Proof of Claims question

    We were changed from a no-asset Chap 7 to an asset Chap 7 when our house was valued higher than we thought it would by the trustee's appraiser. We were able to reach a settlement amount with our trustee and a relative gave us the money to pay it.

    Our deadline for POC has been set at 12/13/06. Our last day for objections is 9/19.

    My questions are:
    1) Could we still be discharged around 9/19?
    2) Does 12/13 have to come and go before we can be closed? (I'm thinking this is a stupid question.)
    3) If the answer to #2 is yes, does anyone know of any ballpark timeframe between the POC deadline and the closing of your case?

    Just as a general question, does anyone know how the amount is disbursed among those who file claims? The amount we paid was about 5% of our total unsecured debt. So if all file a claim, the amount they receive will be tiny.

    Thanks to everyone for this forum. It has helped me to sleep better many nights...well...that and Prozac!

    Hi NowOrNever,

    1) Yes, it's possible, a few days after that date.
    2) Of course.
    3) Probably 1+ year from the claims bar date. But it's really just paperwork for the trustee at that point - nothing for you to do.
