My Chapter 7 was discharged in April 2004, however I owed tax refunds so my Trustee has filed a motion which has kept my BK file active. In June 2004 following a chain of events I had title to the family put into my name to protect it.
I have a buyer for the home but title requires that I have a document which shows that I can sell the home.
If I paid the tax refunds which the Trustee is seeking will that effectively close my BK? And how long before I can sell or obtain a document which shows all my obligations to Trustee has been met? Title is seeking document that shows I can sell. A stipend will take anywhere from 2-4 weeks to get through the judicial system. Is there any other instrument out there that will not have repurcussions against me?
A friend has offered to loan the money but will not loan it if I cannot repay. If I can sell the house I can repay out of escrow.
My buyer is threatening to walk because they were suppose to be in the house on Mar. 1, 2005 and my family out by Feb. 28, 2005. I have let my BK attorneys know this but they have not answered or returned my calls.
I cannot even give an addendum to the buyers offer without knowing how long I am asking them to wait.
