    Perkins loan reported in default in an open Chapter 13?

    Hello!

    I got notification yesterday that - after 18 months into my Chapter 13 bankruptcy - my previous school listed my Perkins loan in default status with NSLDS, making me ineligible for any further student aid. The Perkins loan was included in our bankruptcy along with several others.

    This blows for several reasons: I've been working hard on my credit rating and I had planned on returning to school this summer. I spoke with the head of the office who told me that they can change my status in NSLDS to default, they just cannot pursue collection action.

    I've had no notification of pending default, and so have had oppotunity to prevent this. Furthermore, ALL of my other loans - Stafford loans serviced through the government - are currently listed in bankruptcy status.

    Is this legal? What is the best way to handle this? Any help would be greatly appreciated. Thank you!
