    What files does a plaintiff have access to?

    If an AP has been filed, what files from your BK would the plaintiff have access to? For instance, if the US Trustee had asked for a lot of additional information during the course of the Ch 7, would the plaintiff in the AP then have access to review those all of those files as if they were part of the original filing? What is the scope?

    They will have immediate access to everything filed with the bankruptcy court which does not include the information the trustee requested. Like any other litigation, the plaintiff can also conduct discovery in which they request information relevant to the case. You are required to provide all responsive information unless it is privileged or there is some other reason under evidence rules that you don't have provide the information.
