    Gambling relapse

    Hello everyone, need some advice until I can see my attorney. I have an active chapter 13 that has not been confirmed yet. I filed this past February. I have since had a gambling relapse this month that resulted in a few jackpots that I subsequently lost. Firstly, will my case be dismissed for gambling , and can I add the winnings to my existing payments? I have none of the winnings to show for it as they were gambled back. I have voluntarily self excluded from the casino and called the compulsive gambling hotline and seeing a psychiatrist. It seems the medication I am on for depression has a side effect of compulsive gambling. I have also stop taking that medication. I am losing sleep Over my mistake. Any feedback would be appreciated, thank you.

      When I had to take care of my dad's compulsive gambling tax returns, I was always able to use records from the casino's reward program to offset the jackpots and W2-G forms. I don't see how you could owe anything. Nobody who does slots frequently is going to have positive net income from it.

        You'll have to sit down and have a good and thorough discussion with your attorney. If you have medial issues, such as depression, and this gambling addiction is truly problematic for your Chapter 13, then that discussion may include withdrawing from the Chapter 13. The Chapter 13 Trustees, and really the judges, are likely to be lenient the first time, but after some time it's just the case that you don't fit into the Chapter 13 program. If you are required to contribute your winnings to the Chapter 13, then they "may" allow you to amortize the payback over more than just 6 months; they may allow it over the remaining months of your Chapter 13.

        I would really like you to continue to get and receive treatment for the addiction. I had it at one point and I ran up a lot of money in losses and lots of winning too. It's euphoric... but it's also depressing when you come down from the excitement of gambling. As you know, bankruptcy is never going to cure a gambling addiction as it's meant to solve only the debt. To get past the debt we have to stop creating the debt.

        I can't say whether they will be as forgiving as I would be forgiving. I understand. The key here is to have that honest and open conversation with your attorney. Bring medical reports or letters when and if you schedule a sitdown with your attorney. Since you are pre-confirmation, you may want to discuss possibly dismissing your case and starting over in a few months.
