    Transfer car title

    At what point can I transfer title of my car that has no loan on it to my spouse in a ch 13?

    Her credit is ok and mine is shot. Reason is she could use the car to buy a new one as a trade in. Not sure if the trustee will let me transfer during the plan.

    Btw 100 % plan.

    That's a question for your lawyer and Trustee. Until you hold title -- you don't owe any more money -- it's technically property of the estate, although it is vested in you.

    You need Trustee permission to sell or dispose of any property.

      Even though you owe no money it is considered part of the estate. Any transfer could be considered fraud if it is transferred within 1 year of the filing. Some states go back 10 years depending on the asset. The trustee could look at it as trying to hide assets. I would ask your lawyer if this is even a smart thing to do.
