    $0 monthly net income after expenses - can we still qualify for 13? numbers below

    schedule I $5293.18
    schedule J $5297.85
    monthly net income -4.67

    There's nothing left to pay the trustee. What's the lowest monthly net income you can have and still do a chapter 13?

    Well, first, what are you trying to accomplish by filing chapter 13?

    However, to answer your question...NO. You need to show some disposable income for something, otherwise your plan is not feasible and will be dismissed.

      we were minus almost 3k and we still had atty's pushing us towards 13's. we ended up filing a chapter 7 no asset.

      you didn't break down your expenses...so to make certain, i would like what you did, so people on the forum can get a better picture of the FULL plan..

          here! here! jacey, i don't want a rope around my neck, unless i absolutely HAVE to have one!

          (that's only my personal view of 13's MANY MANY people have been very successful filing 13's). just not in our live situation.

            We want to keep our house. I know many people here see no point in keeping their houses but it's a decision we would like to make.

              That is what I figured. Then, you have to show enough disposable income to at least pay the arrears, pay your attorney, and pay the trustee. Basically, you will need to manipulate your budget.

              However, it is time for reality check...

              If your mortgage payments combined with your chapter 13 payment is more than 30% of your Gross monthly income, you shouldn't be doing it. You CANNOT afford your home, period.

                We were negative by over $1000 when using IRS standards, but had to pay in a minimum of $608/mo (car payment, trustee fees, attorney fees, 0% to unsecured) so we just had to finagle our numbers and make them work. If you want a ch.13, then you have to cut back other areas to make it happen. That said, is it realistic for you to be able to make it work for 3-5 years? Are there "padded" areas on your schedule J? What is the minimum you have to pay in to keep your home?
                Filed Chapter 13 on 2-28-10. 341 completed 4/14/10. Confirmed 5/14/10. Lien strip granted 2/2/11
                0% payback to unsecured creditors, 56 payments down, 4 to go....
