    Reaffirmation of Auto Loan with Credit Union

    I have completed the 341 meeting and have received reaffirmation agreements in the mail from the credit union. I also had an unsecured signature loan with the same credit union that is listed in the BK petition for discharge.

    Questions:

    1) If I reaffirm the amount of the car loan with the credit union, can they use the cross-collateralization language in the original agreement to come after the unsecured loan?

    2) Will it render the unsecured loan undischargeable?

    3) Can they hold the lien on the car until "all debst are paid" even though the unsecured amount is discharged?

    Thanks for any advice.

    yes. if your credit union has a cross-collateralization cause in the loan agreement and they choose to enforce it they can hold the title to the car
    until both loans are paid off. THe quesiton will be whether they enforce it or not. If the car is upside down they may not enforce it, they may just
    be happy to get it paid off.

      Makes sense, but can they do anything to the unsecured debt to "undischarge" it so-to-speak?
