    A question about lift a stay

    If you are one payment behind on a car payment, but only have 2 payments left, and file chapter 7, would the finance company file to lift the automatic stay or with only 2 payments left anyway, would they give you the opportunity to make it current?

    None of us can speak for your creditor.
    It would make no sense to file for relief from stay under those circumstances but, they would have the right.
    I'd suggest you have a plan in place to get current in a hurry.

      It makes sense to file for relief if you have a vehicle that is worth more than the two payments. Of course, it takes a pretty heartless bastard to do that, but there are some that will.

      Get caught up, get current, and do it now.

        I'd say it all depends on the lien holder. It's their rite if they would want to do so, but under that circumstance, it seems like more hassle than it would be worth.
