    Car payment

    We decided to reaffirm a car during ch.7 We have cont to make payments and havent ever miss one but when my husband calls in they say thank you for your volunteering payment. Can anyone tell me what that might mean? Do you not have to make payments while in ch.7?

    Sounds like you have not yet reaffirmed. Have you signed a reaffirmation agreement that has been filed with the court?

      If you plan to keep it, you must continue payments. Period.

      Many finance companies will keep your file in their BK department pretty much forever, which will result in the reply you get from the own company. Even if you reaffirm, your file may be "tagged" in their internal system with a BK notice.

      No worries. Creditors can get absolutely hammered by the courts for violating BK terms, so in many cases they err on the side of caution and treat you with the same BK "stigma" well after your discharge.

      However, you should probably call them and speak to someone in their BK department to ensure that your status is understood - that you intend to keep the vehicle and continue making on-time payments. Many reaffirmations get lost in the shuffle, and you don't want the finance company to try to take back the vehicle. Just talk to them. Let us know what you hear.

      Lady in the Red is correct that you should look for a completed reaffirmation agreement in your paperwork. If you have it, send it to the finance company. If not, it is a good idea to talk to them and make sure you are all on the same page.
