    How does child support count as income for BK purposes?

    I am concerned about this. I get about 10.5k in child support per year for my kids on top of my wages. My ex however is retiring from his govt job next month, and is planning on filing a modification due to what will be his reduction in income. SO the kids child support amount will change. How is this calculated during the filing of BK process? Is it advisable to wait on filing until that is complete? The attorney I met with didnt say much about it.

      I'm not sure of the answer, but if the current support keeps you from passing the Chap 7 means test and a reduction would make a difference, waiting until there is an order reducing the support is probably a good idea. If you would file a Chap 13 even with reduced support, you could file now and modify the plan later.

      If the attorney you talked to can't or won't answer this question, consult with a different attorney.
