    Foreclosure Sale & Eviction Notice Question

    I have called several apartment/home rentals and been honest about filing for chapter 7 and having a foreclosure on my record. Almost all responded that it wouldn't matter unless there was an eviction.

    It has been strongly advised to wait after foreclosure until the sale and ensure the deed has been transferred before leaving the property.
    Is the homeowner notified that the property has been sold?
    If so, does this come as a request to vacate?
    If an eviction notice is issued and the homeowner leaves prior to the final date of the notice is this still considered an eviction? Or does the eviction need to be carried out by legal authorities for it to be considered an eviction?

    Once the home is sold, you negotiate a reasonable move-out timeframe with the new owner--such as a month or two--with the agreement (in writing) that you will move out by then and leave the house clean and in good condition. Whoever buys the house at foreclosure--whether it is the mortgage lender, the HOA, or a private investor--would rather give you time to move out peacefully than have to deal with the expense of filing an eviction suit, and the risk than an angry former homeowner being forced to leave in a hostile way will trash the place. You are worrying about this too much. When the house sells, you will have time to move and find an apartment.
